Terms and Conditions of Hire
These Terms and Conditions apply to all individuals and organizations hiring Garth Community Centre. By proceeding with the hire, the Hirer agrees to comply with these Terms and Conditions.
- General Responsibilities
1.1 Respect for Property
The Hirer must ensure that all persons attending the event respect the property of Garth Community Centre, including the building, fixtures, fittings, equipment, and surrounding areas.
1.2 Supervision and Conduct
The Hirer is responsible for the supervision and conduct of all attendees, including children. The Hirer must ensure that guests behave in an orderly manner and do not cause damage to the premises or disturbance to others.
1.3 Capacity Limits
The Hirer must not exceed the venue’s capacity limits for safety reasons. This applies to all rooms hired and outdoor areas.
- Use of the Venue
2.1 Permitted Use
The Hirer must only use the venue for the purpose stated in the Hire Agreement. Any unauthorized use (e.g., public events, ticketed events, parties not disclosed at the time of booking) may result in immediate termination of the hire and forfeiture of the deposit.
2.2 Prohibited Activities
The following are strictly prohibited:
– Smoking within the premises.
– The use of open flames (including candles)
– Illegal substances or any form of illegal activity.
– Excessive noise that disturbs nearby residents or businesses.
– Any form of vandalism, graffiti, or deliberate damage.
- Damage and Cleaning
3.1 Damage to the Venue
The Hirer will be held responsible for any damage to the Centre, its furniture, fittings, and equipment caused during the hire period. The Venue reserves the right to withhold part or all of the Hirer’s deposit and invoice the Hirer for any additional costs incurred in repairing or replacing damaged property.
3.2 Inspection and Reporting
A Venue representative may inspect the hired area before and after the event. The Hirer must report any damage or faults noticed during their event immediately. Failure to do so may result in additional charges.
3.3 Cleaning Responsibilities
The Hirer is required to leave the venue in a clean and tidy condition. All waste bins must be emptied and all rubbish removed. Failure to meet this requirement may result in additional cleaning charges, which will be deducted from the deposit or invoiced to the Hirer.
- Nuisance and Noise Control
4.1 Noise Levels
The Hirer is responsible for ensuring that noise is kept to an acceptable level during the event. Amplified music or loud noise must cease by 10pm to comply with local noise regulations. The Venue reserves the right to stop any activities causing excessive noise.
4.2 Disruption to Neighbours
The Hirer must ensure that guests do not cause disturbance or nuisance to local residents or other users of the Centre. This includes avoiding loitering, shouting, or loud behaviour in outdoor areas and when arriving at or leaving the Venue.
- Safety and Security
5.1 Health and Safety Compliance
The Hirer is responsible for ensuring compliance with all health and safety regulations during the hire period. This includes ensuring that fire exits are not obstructed and that emergency procedures are communicated to attendees.
5.2 Security of the Venue
The Hirer is responsible for ensuring the security of the Venue during the hire. All doors and windows must be securely locked upon leaving, and any loss of keys must be reported immediately. The cost of replacing lost keys or damage resulting from negligence will be charged to the Hirer.
- Termination of Hire
6.1 Breach of Terms
The Venue reserves the right to terminate the hire immediately if there is any breach of these Terms and Conditions, especially in cases of:
– Unruly or dangerous behaviour.
– Damage to property.
– Excessive noise or disturbance to others.
6.2 Eviction of Guests
The Venue may ask the Hirer to remove or evict any guest whose behaviour is deemed disruptive or dangerous. Failure to comply will result in the immediate termination of the event, forfeiture of the deposit, and potential reporting to the authorities.
- Deposit and Liability
7.1 Deposit
A refundable security deposit for parties is required to cover potential damage, excessive cleaning, or breach of these Terms and Conditions. The deposit will be returned within 7 days after the event, subject to a satisfactory inspection of the premises.
7.2 Liability for Damage
The Hirer is liable for all costs related to damage caused during the hire period. This includes damage to the building, equipment, or any other property owned by Garth Community Centre.
7.3 Third-Party Liability
The Venue accepts no liability for injury, loss, or damage to the Hirer or their guests, unless caused by the Venue’s negligence.
- Insurance
8.1 Public Liability Insurance
The Hirer is advised to have public liability insurance to cover any incidents arising during the event. The Venue may request proof of insurance for large or public events.
- Indemnity
The Hirer agrees to indemnify and hold Garth Community Centre, its staff, and volunteers harmless from any claims, liabilities, damages, or expenses arising from the Hirer’s use of the Venue, including any injury or damage caused to third parties.
- Amendments
Garth Community Centre reserves the right to amend these Terms and Conditions at any time. The Hirer will be notified of any significant changes prior to their event.
By proceeding with the hire, the Hirer confirms that they have read, understood, and agreed to these Terms and Conditions. Failure to comply with these conditions may result in additional charges, termination of hire, and loss of deposit.
